This is a petition filed under Section 482 Cr.P.C. for issuance of directions to respondents No.1 and 2 to look into the matter related to FIR No.169 dated 04.07.2018, under Section 346 IPC, registered at Police Station Babain, District Kurukshetra.

Learned State counsel has submitted that in the present case, the police has submitted the cancellation report and the petitioner has made a statement before the Judicial Magistrate Ist Class, Shahbad on 31.05.2023 that he agrees with the police record and will not pursue the proceedings. He further submitted that the cancellation report has been accepted by the Judicial Magistrate Ist Class, Shahbad and thus, the present petition has become infructuous and as such, the same be disposed of. 3.

It is submitted that a perusal of the cancellation report would show that the police, after investigation in the case, has come to the conclusion that Mange Ram son of the petitioner had died on account of DINESH BANSAL 2023.09.21 16:49 I attest to the accuracy of this order Chandigarh

CRM-M-42751-2019 -22023:PHHC:122908 having fallen down from culvert because of his drunken condition and even as per the opinion of the Doctor, the cause of death is blunt ante-mortem lower extremity trauma, consistent with the fall from a height and further found that the said Mange Ram was habitual of drinking liquor and also suffered an accident six months prior in which his leg got broken. 4.

No one has come present on behalf of the petitioner to rebut the said facts.

Keeping in view the said facts and circumstances, no further action is called for in the present petition and the same is disposed of as having been rendered infructuous.
