NIDHI GUPTA, J. (ORAL) Prayer in this 1st petition filed under Section 439 Cr.P.C., is for grant of regular bail to the petitioner in case FIR No. 99 dated 09.05.2023 registered under Sections 363, 366-A, 506 and 328 IPC and Section 8 of the Protection of Children from Sexual Offences Act, 2012, at Police Station Raipurani, District Panchkula. Learned counsel for the State has filed custody certificate dated 23.09.2023, which is taken on record, as per which the petitioner has been in custody as an undertrial for a period of 04 months and 13 days.

After arguing for some time, learned counsel for the petitioner submits that he may be permitted to withdraw the instant petition, at this stage.

Permitted to do so.
