NAMIT KUMAR J. (Oral) The appellants have filed the instant appeal against the judgment and decree dated 09.10.2013 passed by the learned trial Court whereby the suit for recovery filed by the appellants/plaintiffs has been dismissed as well as the judgment and decree dated 14.05.2015 passed by the learned Appellate Court whereby the appeal preferred by the appellants/plaintiffs against the aforesaid judgment and decree dated 09.10.2013, has also been dismissed.
On the last date of hearing, notice was issued to the respondent.
As per office report, notice issued to respondent has been received back with the report that he has died. In this view of the matter, learned counsel for the appellants submits that he shall not press the instant appeal, at this stage, however, liberty may be granted for revival of the same in case any execution is filed by the legal representatives of the respondent. Disposed of with aforesaid liberty.
