The instant petition has been filed under Section 438 Cr.P.C. for grant of anticipatory bail to the petitioner in case FIR No.0058 dated 31.08.2019 registered under Sections 376, 506, 120-B IPC and under Section 4 of the POCSO Act, 2012 at Police Station Sekhwan, District Gurdaspur.

By an order dated 03.10.2019, while issuing notice of motion, this Court had granted interim bail to the petitioner and directed him to join investigation.

Learned counsel for the petitioner herein would contend that the petitioner has been falsely implicated in the present case, however, pursuant to the order dated 03.10.2019, petitioner has joined investigation. 4.

Learned counsel appearing on behalf of the respondent-State on instructions from ASI Baljinder Singh submits that petitioner has joined investigation, however, proceedings qua main accused namely Gurwinder Singh to declare him as proclaimed offender are under process. It is also submitted that investigation qua petitioner is complete and challan has been presented.

I have heard learned counsel for the parties. 6.

In view of the fact that the petitioner has joined investigation and the challan qua him has been presented, the instant petition is allowed and the order dated 03.10.2019 granting interim bail to the petitioner is made absolute, subject to the conditions laid down in Section 438(2) Cr.P.C.
