Learned counsel for the petitioner submitted that the petitioner is appearing before the trial Court for the last 05 years and he has not absented himself even in a single day and on 30.04.2025, the case was fixed for prosecution evidence and no prosecution evidence was present and it was due to the noted down of the wrong date.

The petitioner is directed to appear on or before 05.09.2025 before the learned trial Court and the trial Court is directed to decide his bail application sympathetically taking into consideration the aforesaid plea raised by learned counsel for the petitioner. Till then, his non-bailable warrants shall remain in abeyance. However, if he fails to surrender before the trial Court on or before 05.09.2025, then the relief granted by this court deems to be withdrawn. 4.
