Learned counsel appearing on behalf of the parties submit that the parties have already compromised their dispute and the same has already been recorded in writing on 11.06.2021. Learned counsel for the parties further submit that the parties intend to comply with the terms and conditions of the said compromise. Hence, the present Regular Second Appeal be disposed of in terms of the written compromise dated 11.06.2021 by exercising powers under Order 23 Rule 3 of the CPC. Keeping in view the fact that the parties have already amicably settled their dispute, the present Regular Second Appeal is being disposed of in the terms of the compromise dated 11.06.2021. Learned counsel for the parties submit that in case, there is any confusion with regard to the understanding of any terms and conditions, the party be given chance to avail appropriate remedy as available. The compromise be made part of the decree.
