The plaintiff's application for impleading Sucha Singh Rakkar as defendant in the suit for declaration with regard to the property left behind by Smt. Balvir Kaur has been allowed. The petitioner is defendant No.1 in the aforesaid suit. The Court has found that there is prima facie material to show that Sucha Singh Rakkar is the husband of Smt.Balvir Kaur as his name is recited in her passport.

The learned counsel representing the petitioner contends that the plaintiff is required to prove that Smt. Balvir Kaur was married to Sucha Singh Rakkar after the death of her husband Buta Singh. The petitioner, if so advised, may request the Court to frame a distinct issue on this matter. 3.

With the observations made above, the present revision petition is disposed of.
