Instant petition has been filed under Section 11 (5) of the Arbitration and Conciliation Act, 1996 (for short "the Act"), for appointment of an Arbitrator to adjudicate the claims arising out of the disputes between the parties.

Upon notice, Mr. Navneet Jindal, Advocate has put in appearance on behalf of the respondent and has filed Power of Attorney as well as Authority Letter, which are taken on record. Counsel representing the respondent has instructions to state that he does not have any objection to the appointment of an Arbitrator, however, he submits that claim raised by the petitioner is barred by limitation. He submits that although there is provision in Arbitration Clause 14 for the Appointment of a Panel of 3 Arbitrators, but he has requested that a sole Arbitrator to be appointed at Chandigarh.

Counsel for the petitioner has consented to the appointment of the sole Arbitrator at Chandigarh.

In view of the above, petition is allowed. Hon'ble Mr. Justice Sant Parkash (Retd.), # House No.39, Sector 24-A, Chandigarh, is requested to act as the sole Arbitrator to adjudicate the dispute between the parties, subject to compliance of statutory requirements. 5.

Parties are directed to appear before the Arbitrator on the date, place and time to be fixed by the Arbitrator at his convenience. 6.

Copy of the order be communicated to Hon'ble Mr. Justice Sant Parkash (Retd.).

Liberty is granted to the parties to raise all the claims/counterclaims/defence etc., before the learned Arbitrator.
