(Oral) The challenge in this Letters Patent Appeal filed under Clause X of the Letters Patent is to the common order dated 27th January, 2016, passed in CWP No. 16457 of 2011, titled as, "Anil Sheikhar Vs. State Bank of India and others", whereby, the services of the appellant as Customer Relationship Executive terminated by the respondent Bank has been upheld while dismissing the said batch of writ petitions on the ground that he failed to achieve minimum 60% targets. Further, the impugned judgment has been set aside by this Court in LPA No. 739 of 2016, decided on 12.01.2018 in CWP No. 17374 of 2011 and the case has been remanded back to the Single Judge for consideration and arguments. 2.
Learned counsel for the appellant submitted that he may be allowed to withdraw the present Letters Patent Appeal (LPA), as the same has been filed belatedly. However, it was prayed that liberty be granted to the appellant to approach the authorities concerned, in case they pass any favourable order in the other similar cases, which were remanded by the Coordinate Bench of this Court. 3.
