The plaintiff who filed the suit to declare the order of termination effected as illegal asking for mandatory injunction for payment of ` 57,000/- and odd for salary of three months was faced with result of dismissal at the trial Court which was affirmed by the Appellate Court. The plaintiff would contend that he also filed a suit for damages for ` 3 lacs but the suit was dismissed for non-payment of court fee. The counsel would restrict his contention only with reference to damages. I failed to understand as to how it is possible for the Court to address such an issue when his own suit for damages filed independently came to be dismissed for non-payment of court fee. 2.

I do not find any error in the judgments of the Courts below for intervention for the relief which is restricted before this Court now and dismiss the appeal as devoid of merit.
