Challenge in the present revision petition under Article 227 of the Constitution of India is to the order dated 27.02.2024 (Annexure P-1) passed by learned Sub Divisional Judicial Magistrate-cum-Additional Civil Judge (Senior Division), Samalkha, District Panipat, whereby notice of application under Order 39 Rule 2-A CPC has been ordered to be issued to the petitioner along with other respondents.

Learned counsel for the petitioner submits that petitioner was not a party to the suit wherein the order dated 16.06.2023, as modified vide order dated 05.07.2023, was passed.

After arguing for some time, learned counsel for the petitioner seeks withdrawal of the present revision petition with liberty to take up all the VARINDER PRASHAD 2025.03.10 17:39 I attest to the accuracy of this order/judgment PHHC
