Present petition has been filed under Articles 226/227 of the Constitution of India praying for issuance of writ in the nature of mandamus directing the respondents to grant the petitioners the pay scale of Rs.2000-3500 w.e.f. 01.01.1986 and to revise the same to Rs.2200-4000 w.e.f. 01.03.1991 and to grant proficiency step-up of Rs.3000-4500 after 8 years of service and second proficiency step-up after completion of 18 years of service in the pay scale of Rs.3700-5300 as being granted to the Junior Engineers working in the Soil Conservation Department as per letter dated 13.01.1997 (Annexure P-4) issued by the Department of Agriculture with all consequential benefits such as arrears of pay etc. Further prayer has been made for directing the respondents to grant the petitioners the revised pay scale as recommended by the 5th Pay Commission corresponding to the scales mention were in before with all consequential benefits. 2. Learned counsel for the petitioners at the outset confines her prayer for deciding three legal notices dated 23.03.2024 (Annexure P-12). She submits that at this stage, petitioners would be satisfied, if the said legal notices are considered and decided by passing a speaking order in a time-bound frame.

4. Mr. Rajesh Sehgal, Addl. A.G., Punjab, accepts notice on behalf of the respondents and has no objection to the prayer made by learned counsel for the petitioners.

5. I have heard learned counsel for the parties and have gone through the record of the case.

6. Without expressing any opinion on the merits of the case or the claim being made by the petitioners in the present petition, respondent No.3 is directed to consider and decide the claim made by the petitioners in three legal notices dated 23.03.2024 (Annexure P-12) in accordance with law, by passing a speaking order within a period of three months from the date of receipt of certified copy of this order.
