The present petition has been filed under Section 482 of BNSS, 2023 for grant of anticipatory bail to the petitioner in case FIR No.126 dated 09.06.2025, under Sections 15(b), 27(a) of NDPS Act, 1985 and 61 of Excise Act and 123 of BNS, registered at Police Station Sadar Tohana, District Fatehabad.

The case of the prosecution is that 01 Kg 700 grams of poppy husk along with 200 Litres Lahan (illicit liquor) was recovered from accused namely Amarjeet Singh @ Amri. On his disclosure statement, name of the petitioner was surfaced in the present FIR. It is stated that the recovered poppy husk belonged to the petitioner and he sold it to the main accused. 3.
Learned counsel for the petitioner submits that petitioner has been falsely implicated in the present case as apart from disclosure statement of co-accused, there is no evidence to connect the petitioner with the alleged recovery of contraband.

On the other hand, learned State counsel has vehemently opposed the prayer of the petitioner and submitted that the petitioner has committed a serious offence and further prayed for dismissal of the bail application. 5.
I have heard learned counsel for the parties and perused the record.

Keeping in view the above and the fact that the petitioner is involved in another case under NDPS Act, no ground is made to grant him the concession of anticipatory bail at this stage. Hence, the present petition is dismissed.
