The petitioner through instant petition under Articles 226/227 of the Constitution of India is seeking directions to respondents to issue passport.

The petitioner has applied for passport and her application was closed on 16.09.2014. The petitioner again applied for the passport vide application dated 27.04.2023. The petitioner before filing fresh application got issued birth certificate from the office of Registrar, Birth and Death, Municipal Corporation, Ludhiana.

Learned counsel for the petitioner submits that application of the petitioner has been kept pending without any rhyme or reason. The petitioner is not involved in any criminal case, thus, there is no reason to keep the matter pending. He further submits that the case of the petitioner is squarely covered by the judgment of this Court in Mohan Lal @ Mohna vs. Union of India and others, 2023 SCC Online (P&H) 1391.

Ms. Monica Chawla, Central Govt. Counsel, who on advance notice is present in Court, submits that the passport authority has issued letter dated 21.09.2023 asking the petitioner to furnish information with respect to her earlier application for passport. The petitioner may be directed to appear before the passport authority along with requisite documents and if she appears along with requisite documents, the competent authority would pass an appropriate order within 04 weeks. 5.

In the wake of statement of learned counsels for the parties, the petitioner is directed to appear before the respondents on 19.10.2023 along with requisite documents. On doing so, the appropriate authority would pass an order within 04 weeks thereafter.

The petition stands disposed of.
