The petitioner through instant petition under Articles 226/227 of the Constitution of India is seeking direction to respondents No. 1 and 2 to release his passport which was seized at Airport. 2.

The petitioner is holding passport bearing No. N8535134 which is valid upto 31.03.2026. The petitioner is involved in two criminal cases and is facing trial. The petitioner after seeking approval from trial court, planned to visit Canada. While the petitioner was leaving for Canada, the Immigration Authorities posted at Indira Gandhi International Airport, New Delhi, on 05.09.2023 seized passport of the petitioner. The said passport has been delivered to passport authority at Chandigarh on 20.09.2023. Counsel for the petitioner submits that the petitioner was PARAMJIT KAUR SAINI 2023.09.21 17:26 I attest to the accuracy and authenticity of this order/judgment

CWP-20999-2023 -2- 2023:PHHC:124122 visiting abroad after getting prior permission of trial Court, thus, the respondents had no authority to seize or impound the passport. 3.

Learned counsel for Union of India, who on advance notice is present in Court, submits that passport authority has received passport from Immigration Authorities and petitioner may be directed to appear before passport authority alongwith relevant documents who would look into grievance of the petitioner.

Learned counsel for the petitioner agrees to the aforesaid arrangement.

The petitioner is directed to appear before passport authority at Chandigarh alongwith relevant documents. On doing so, passport authority shall redress grievance of the petitioner within a week from today. 6.

Petition stands disposed of.
