Learned State counsel has stated that the complainant was duly informed with regard to the pendency of the present petition and the date fixed. However, nobody has appeared on behalf of the complainantprosecutrix. 3.

Learned counsel for the petitioner submits that it is a case where allegations were made against the petitioner with regard to sexual assault but the complainant did not supported the prosecution version when the statement under Section 164 Cr.P.C was recorded and the present FIR was rather a counter blast of another FIR, which was registered at the instance of the petitioner against the relatives of the prosecutrix namely Matluf @ Golu Khan.

Learned State counsel on instructions from ASI Lakhwinder Singh states that in pursuance of the orders passed by this Court on 12.09.2024 the petitioner has already joined investigation and he is fully cooperating with the investigation process and he is not required for custodial interrogation.

In view of the specific stand taken by the learned State counsel, the present petition is allowed and the order dated 12.09.2024 is hereby made absolute.
