CM-4867-C-2021 in RSA-3312-2016 This is an application under Order 23 Rule 3 CPC r/w Section 151 CPC for disposal of the main appeal on the basis of compromise Annexure A-1.

At the outset, learned counsel for the appellant submits that during the pendency of instant appeal, parties have amicably settled their dispute and arrived at an amicable settlement (Annexure A-1). She thus, prays that the instant appeal may be disposed of in view of the compromise arrived at between the parties.

Learned counsel for the respondent does not dispute the submissions made by counsel for the appellant and prays that the instant appeal be disposed of in terms of settlement (Annexure A-1) arrived at between the parties.
