(Oral) Petitioner - Sukhpreet Kaur, filed present petition under Article 226 of the Constitution of India, seeking a writ in the nature of Habeas Corpus, for releasing of detenues 'Ikattar Singh' father of petitioner and 'Ram Singh', uncle (Chacha) of the petitioner, who were in illegal custody of respondents No.4 & 5.
Counsel for the petitioner submits that present petition was filed in December 2021, and thereafter, on 09th March, 2023, said detenues were released from the illegal custody.
Counsel for the petitioner also submits that there is enough material available on record including that of the report of warrant officer, appointed by this Court, for proving the illegal detention of two persons by the police officials, as alleged in the present petition. However, counsel submits that by arranging the facts & documents in chronological order, he JAWALA RAM 2023.04.11 12:57 I attest to the accuracy and authenticity of this order/judgement.
2023:PHHC:048440 CRWP-12016-2021 - 2 - requires to file a fresh petition, for seeking appropriate remedy in accordance with law. Therefore, he be allowed to withdraw present petition with liberty to file a fresh petition.
In view of the statement made here-above, present petition is disposed of being withdrawn with liberty to file a fresh one, as requested by counsel for the petitioner.
