Mr. Ashish Bakshi, Advocate for the petitioner. *** NIDHI GUPTA, J (Oral) As per the last order, the petitioner had been directed to tag the case file of Transfer Application No.1005 of 2022 with this case. A perusal of case file of said transfer application shows that the petitioner had sought transfer of case No.DMC/508/2019 (Annexure P5) which was "suit for declaration to the effect that order dated 31.03.2016 passed by the Court of Ms. Harveen Bhardwaj, ADJ, Jalandhar in case No.DMC/168/2015 titled as Gurmail Singh vs. Manjinder Kaur is valid and legal and binding upon the defendant". The said transfer application was allowed by this Court vide order dated 01.09.2022. It transpires that in the present petition, the petitioner is again seeking transfer of same suit for declaration (Annexure P2).

When confronted with this, learned counsel for the petitioner states that there was a mistake in the earlier transfer application as transfer therein was sought of the Section 13 of HMA petition filed by the respondenthusband. After arguing for some time, the petitioner now seeks to withdraw the present petition.

Dismissed as withdrawn with payment of costs of Rs.5000/- to be deposited with the Legal Services Authority, High Court; and liberty to file any fresh proceedings, if required, in accordance with law.
