The present regular second appeal pertains to the year 2016 and the same is still at the stage of preliminary hearing inasmuch as notice of motion is yet to be issued. Vide order dated 26.09.2018 the case was adjourned sine die and was to be listed after the decision by the Larger Bench in RSA4181-2016. The matter was put up before the Court on 19.08.2025 when none appeared on behalf of the appellant despite the matter being called thrice and the case was adjourned to 28.08.2025. On 13.11.2025 again no one put in appearance on behalf of the appellant despite the matter being called twice. The case was adjourned to today.

Today, despite the matter being called twice since morning, no one has put in appearance on behalf of the appellant. In view thereof, this Court is left with no other option but to dismiss the present regular second appeal for non-prosecution. 4.
