  **** HARNARESH SINGH GILL, J.(Oral) Through this second petition, the petitioner seeks regular bail in case bearing FIR No.09 dated 26.01.2021, registered at Police Station Guruharsahai, District Ferozepur, under Sections 365 and 120-B IPC and Sections 302 and 201 IPC (added later on) and Section 364 IPC (added at the time of framing of charge), the first one having been dismissed as withdrawn on 07.04.2022.

Learned counsel for the petitioner submits that there is a delay of 39 days in the registration of the above-noted FIR; that initially, the mother of Sonu had got registered rapat dated 23.12.2020 qua missing of her son since 17.12.2020; that neither the dead body of Sonu (alleged deceased) nor his motor-cycle was recovered by the police, and that out of 18 prosecution witnesses, 06 witnesses have already been examined.

CRM-M-49568-2022 (O&M) -2At this stage, learned State counsel, on the instructions from ASI Atma Singh, submits that all the prosecution witnesses have already been examined and the case is at defence evidence. Upon this, learned counsel for the petitioner does not press this petition.
