Although, in the head note of the petition, it is mentioned that this is the second petition, but learned counsel for the petitioner has clarified that in fact the first petition was filed before the Court of Sessions, which was dismissed on 14.09.2023 (Annexure P-2). 3.

By way of this petition filed under Section 439 Cr.P.C., prayer is made for grant of regular bail in case FIR No.55 dated 11.08.2023, under Section 22(b) of Narcotic Drugs and Psychotropic Substances Act, 1985 (for short 'the NDPS Act'), registered at Police Station Bariwala, District Sri Muktsar Sahib. 4.

Allegations against the petitioner are that the petitioner was found in possession of 100 tablets of Colovidol-100 SR containing the salt Tramadol Hydrochloride.

Though, status report has not been filed, but it is informed by learned State counsel that average weight of the tablets was 378 mg. and SARITA RANI 2023.11.28 16:57 I attest to the accuracy and integrity of this document/order

CRM-M-47492-2023 - 2 - thus total weight was 37.8 grams, which falls in the non-commercial category, as the commercial category starts from 250 grams. 6.

As per custody certificate placed on record, petitioner is in custody for the last 03 months and 15 days, though he is involved in one more case of NDPS Act.

Having regard to the fact that the recovered quantity falls in the non-commercial category, but without commenting anything else on the merits of the case, petitioner is admitted to bail. He is ordered to be released on regular bail on his furnishing adequate bail bonds and surety bonds to the satisfaction of learned Trial Court/Duty Magistrate concerned.
