Mr. Rose Gupta, Advocate and Mr. Prateek Garg, Advocate for the petitioner. **** Anupinder Singh Grewal, J. (Oral) Learned counsel for the petitioner submits that the petitioner was allotted a retail petrol outlet in the year 2012 by respondent No.2. He was also issued a provisional 'No Objection Certificate' on 07.02.2013 and the outlet is operational since 2013. The respondent No.2 had made an application on behalf of the petitioner for issuance of the final NOC on 31.01.2014 but the respondents have not taken any action thereupon and issued impugned notices dated 06.03.2025 and 08.07.2025 (Annexure P-14).

At the asking of the Court, Ms. Sonia Madaan, Advocate accepts notice on behalf of respondents No.1, Mr. Ashish Kapoor, Advocate accepts notice on behalf of respondent No.2 and Mr. Deepak Bhardwaj, Addl. A.G. Haryana accepts notice on behalf of the respondent No.3. Learned counsel for the respondent No.1 submits that the petitioner had been sent notices to submit his application by completing the formalities under the MoRTH guidelines for grant of of the requisite permissions and thereafter, his application would be considered. Learned counsel for the petitioner submits that that respondent No.2 would comply with the afore-noted MoRTH guidelines and submit a fresh application to the respondents.

The petition is disposed of in the event of the respondent No.2 submitting an application after complying with the MoRTH guidelines within a period of 30 days. His application would be considered and decided in accordance with law by respondent No.1 within a period of 30 days thereafter. 6.

Meanwhile, the petitioner would continue operating the retail petrol outlet till the final decision is taken.
