Dated Police Station Sections 05.02.2024 Division 302, 307, 427, 148, 149 IPC Amritsar and 25/27/54/59 of Arms Act 1.

Seeking cancellation of regular bail granted to the accused/respondent No.2 in the FIR captioned above, the complainant (petitioner herein) has come up before this Court under Section 483 (3) r/w 528 BNSS 2023.

Counsel for the complainant submits that the applicant had violated one condition of appearing before the trial Court, based on which his bail was cancelled and after that when he had put in appearance, he was again released on bail by the trial Court. He further submits that even when his bail was cancelled and he had re-appeared and again granted bail, that bail had its origin to the bail granted by this Court on 16.05.2025, as such even in the new bail order passed by the trial Court, the conditions imposed by this Court in order dated 16.05.2025, shall continue to remain in operation. 3.

Learned counsel for the complainant submits that in para 15, there was specific direction that accused shall not browbeat, pressurize, induce, threaten any witness, police official or any other person acquainted with the facts and circumstance of the case or dissuade them from disclosing such facts to the police or the Court. CRM-M-41911-2025 had done so through social media posts from inside the jail. 4.

Learned senior counsel Ms. G.K. Mann, assisted by Ms. Amandeep K. Sidhu, on instructions submits that they undertake to delete all the posts made against the complainant within two days from today. They further undertake not to write a word against the complainant and in addition to that they undertake to stay away 500 meter radius of the house of the complainant.

Given the above undertaking, the accused shall delete all the posts made against the complainant within two days from today and would not write anything against the complainant in near future and he shall stay away 500 meter radius from the house of the complainant. Given such extra conditions, this Court is not inclined to cancel the bail/bail bonds.

It is clarified that if the accused repeats the offence, the State may file an application for cancellation of bail before the Sessions Court, which may have the liberty to cancel the bail.

Any observation made hereinabove is neither an expression of opinion on the case's merits nor shall the trial Court advert to these comments. Petition disposed of in terms mentioned above. All pending applications, if any, stand disposed of.
