(ORAL) Petition herein, under Articles 226/227 of Constitution of India is for issuance of a writ in the nature of certiorari quashing order dated 11.12.2021 (Annexures P-12 and P-13), whereby, the claim of the petitioner has been rejected by appointing the private respondent as Executive ViceChairperson (EVC). 2.

Having heard the arguments of learned counsel for the petitioner, I find no ground to interfere.

The question posed by learned counsel for the petitioner in the present proceedings is as to whether having once superannuated and attained the age of 65 years, could the private respondent No.4 be considered and appointed on the post of Executive Vice-Chairperson (EVC) is completely irrelevant. Concededly, by virtue of an Ordinance- "The Haryana Pond and Waste Water Management Authority (Amendment) Ordinance, 2021" (Annexure P-5), promulgated by State of Haryana, the age for appointment MAHAVIR SINGH 2022.01.05 17:48 I attest to the accuracy of this order.

on the post in question, was increased from 65 to 68 years. Neither is the Ordinance under challenge before this Court nor even otherwise, it is the case of the petitioner that private respondent No.4 is above 68 years. 4.

Being so, it is not a case to exercise extra-ordinary writ jurisdiction.

At this stage, learned counsel for the petitioner seeks permission of this Court to withdraw the present petition. 7.
