* * * * KRISHNA MURARI, C.J. (ORAL) The challenge in this Letters Patent Appeal under Clause X of the Letters Patent Act is to the interim order dated 02.05.2017 passed by the learned Single Judge in CWP-8936-2017. The interim order was in the same terms as passed in CWP-7965-2017.

When confronted with the observation that the learned State counsel for the appellant may take the pleas as sought to be raised in the present appeal before the learned Single Judge as the matter is pending there, he made a request to dismiss the appeal as withdrawn with the aforesaid liberty.

Accordingly, the appeal stands dismissed as withdrawn leaving it open to the appellant to take recourse to the remedies as may be available in accordance with law before the learned Single Judge.
