(ORAL) This petition has been filed by the petitioner being aggrieved by the impugned order dated 23.11.2021 (Annexure P-15) passed by the respondent-authorities confirming their earlier order dated 27.09.2021 (Annexure P-8), whereby the petitioner was suspended from being eligible for bidding/award of all future contract(s) of Indian Oil Corporation Ltd. for a period of one year from the date of committing breach of the tender condition(s).
The petitioner has also assailed the show cause notice dated 02.12.2021 (Annexure P-27), by which the respondent-authorities have called upon it to show cause as to why it be not placed on the "holiday list". It is an admitted and undisputed fact that against the order dated 23.11.2021 (Annexure P-15), the petitioner has already taken up the second grievance in terms of clause 8 of the NIT which is pending before the respondent-authorities. It is also an admitted and undisputed fact that the petitioner has filed reply to the show cause notice dated 13.12.2021 (Annexure P-30) which is also pending before the respondent-authorities. Mr. Ramdeep Partap Singh, learned counsel, who has entered appearance on behalf of the respondents, submits that the decision on the second grievance raised by the petitioner against the order confirming its NAROTAM DASS 2022.01.07 15:36 I attest to the accuracy and integrity of this document High Court, Chandigarh suspension and the decision on the show cause notice dated 02.12.2021 shall be
CWP-26290-2021 (O&M) taken by them at the earliest, preferably within three weeks and communicated to it accordingly.
