(ORAL) When an objection was raised by us with respect to maintainability of the appeal, inasmuch as, the impugned order was passed on the concession given by the appellant-management before the learned Single Judge that it was ready to pay compensation to the petitioner, learned counsel for the appellant did not answer to that. It may be relevant to reproduce para No. 6 from the impugned judgment: "6.

At this juncture, learned counsel for respondent no. 2management cited judgment of this Court passed in the case Uttam Kumar vs. The Presiding Officer and another, CWP No. 14356 of 2013, decided on 20.07.2017 and submitted that instead of remanding the matter for holding an inquiry from the defective stage, respondent no. 2 is ready to pay compensation to the petitioner.
