Present petition has been preferred under Article 226 of the Constitution of India for extension of emergency parole for treatment of the wife of petitioner Sukhjinder Kaur. The ground taken is that the doctors are unable to perform the surgery of his wife on account of their strike and therefore, extension is prayed for.

Perusal of the paper book would go on to show that earlier this benefit was granted in Criminal Writ Petition No. 10575 of 2021 vide order dated 13.12.2021, whereby the petitioner was to surrender on 26.12.2021 by 5.00 p.m.

In the considered opinion of this Court, firstly an application would lie in the aforesaid petition and no separate petition is required to be filed as no order as such has been challenged. Secondly, the extension cannot be granted at this stage as no date has been fixed for the surgery of SACHIN MEHTA 2021.12.23 19:21 I attest to the accuracy and authenticity of this document High Court, Chandigarh wife of the petitioner and therefore, it is open to the petitioner to file an
