(Oral) In the present writ petition, the petitioners are praying for issuance of a writ in the nature of Certiorari for setting aside the letter dated 25.09.2019 (Annexure P-4) issued by respondent No.3, whereby petitioner No.1 has been directed to submit a succession certificate from the competent Court for the purpose of release of retiral benefits. 2.

It has been brought to the notice of this Court by learned counsel appearing for the respondents that the children of the second wife of Late Sh. Naresh Kumar have instituted a civil suit before the competent Court, claiming themselves to be the legal heirs entitled to inherit the property and assets of Late Sh. Naresh Kumar. The petitioners herein have been arrayed as respondents in the said suit. It has further been brought to the notice of this Court that the Civil Court has passed an interim order directing the respondent-Municipal DIWAKER GULATI 2026.04.30 09:32 I attest to the accuracy and integrity of this document -1-

CWP-31197-2019(O&M) Corporation not to release the retiral benefits of Late Sh. Naresh Kumar to any person.

In view of the aforesaid facts, learned counsel appearing for the petitioners submits that he does not wish to press the present writ petition and seeks liberty to agitate the issues raised herein in the abovementioned civil suit before the Civil Court. 4.

Accordingly, the present writ petition is dismissed as not pressed.
