Appellant/plaintiff while working as Sectional Officer with Chaudhary Charan Singh Haryana Agriculture University,Hisar (for short the University) was granted promotional scale of Rs.1640-2900 w.e.f. 1.1.1986. However, the defendant University issued a show cause notice dated 24.4.2006 seeking to withdraw the said promotional scale and thereafter passed order dated 17.4.2007 withdrawing the aforesaid promotional scale after a lapse of 21 years,leading to the appellant filing a civil suit No.693-C/26.7.2007. The suit was decreed on 31.8.2012 by learned Civil Judge (Junior Division)Hisar. However, the judgment and decree passed by the trial Court was set aside in appeal filed by the University vide judgment and decree dated 8.7.2016 passed by the lower appellate Court/ADJ Hisar,while proceeding to dismiss the suit of the plaintiff. Hence the present second appeal.

RSA 3646/2016 Upon notice, respondent University has put in appearance. At the time of hearing today counsel for the appellant has prayed for unconditional withdrawal of the appeal in the light of the Vice Chancellor having agreed to grant the selection pay to the appellant.
