AMIT RAWAL J. (Oral) Short point involved in the present appeal is whether suit filed by one of the LRs of Sohan Lal-tenant, for setting aside the order dated 02.09.2011 passed by the Rent Controller, would be maintainable or not, once the ejectment order has already been passed and the appeal was pending.

It is a matter of record that appeal before the Appellate Authority by other LRs of Sohan Lal, had been dismissed, much less, the revision petition filed before this Court. Once the estate of tenant was being represented by the legal representatives of Sohan Lal, thus, the suit at the instance of other LRs of Sohan Lal, is not maintainable. The Regular Second Appeal stands dismissed.
