In the present petition, the challenge is to order dated 15.12.2021 (Annexure P/1) passed by respondent No.3-Central Administrative Tribunal, Chandigarh Bench, Chandigarh. 2.

Learned counsel for the petitioners submits that out of the two private respondents, respondent No.1-Jagjeet Singh has already been compulsorily retired from service whereas, respondent No.2-Jagjinder Singh was subsequently included in the list and was promoted to the post of Head Constable.

Learned counsel for the respondents though, does not deny the said fact but submits that the liberty be given to the respondent No.1 that in case, he remains successful in challenging the order dated 12.08.2024 by AARTI SHARMA 2026.04.18 17:01 I attest to the accuracy and integrity of this document

CWP-26474-2021 (O&M) -2which he has been compulsorily retired from service, he can avail appropriate remedy for the redressal of his grievance qua promotion as well at that stage.

Keeping in view the subsequent events, where, the respondent No.1 has already been compulsorily retired from service and respondent No.2 has already been granted the benefit of promotion subsequently, the present petition is disposed of with the observation that in case respondent No.1 is able to successfully challenge the order of his compulsorily retirement, he will be within his jurisdiction to claim the other benefit of promotion at that stage.

Civil miscellaneous application pending, if any, is also disposed of.
