Grievance raised by the petitioner in this writ petition is that the security amount has not been refunded to the petitioner-Firm by the respondents.

Learned counsel for the respondents, while referring to the written statement dated 02.12.2024 filed by Mr. Kulvir Singh Malik, Deputy Excise & Taxation Commissioner (Excise), Kurukshetra, on behalf of respondents No.1 to 4, submits that the petitioner-Firm was a proprietor firm with one Mr. Dambar Singh being a proprietor. He has passed away on 29.12.2022 but details of his legal heirs/representatives have not been made available to the department, therefore, in the absence of complete details and information, along with necessary undertakings and indemnity bonds, answering respondents are unable to release the huge amount of refund. Faced with the same, learned counsel for the petitioner submits that all necessary details of legal heirs of Mr. Dambar Singh and any other information as may be asked for by the department shall be supplied. 4.

Learned counsel for respondents, on instructions from Mr. Jagdeep, DETC (Excise), Kurukshetra, submits that complete details as are required shall be intimated to the petitioner within one week from today and on receipt of necessary information from petitioner, the case for refund, after any deduction permissible in accordance with law, shall be processed and carried out within the next two weeks.

Keeping in view the specific stand of respondents as above, no further orders are called for. Writ petition is accordingly disposed of with a direction to respondents to take necessary steps in consonance with the statement of learned counsel for respondents.
