The instant petition has been filed on behalf of the petitioner seeking grant of anticipatory bail in respect of aforementioned FIR. 2.

As per the case of prosecution one Harpal Singh and Lakhwinder Singh were arrested by the police and who were found in possession of 1100 intoxicant tablets and 20 grams of 'Heroin'. 3.

It is further the case of prosecution that during the course of interrogation they disclosed that Randheer Singh (petitioner) had also been purchasing intoxicant tablets etc. along with them. Learned counsel for the petitioner submits that admittedly he was never ever found at the spot or any recovery was effected from him and had been nominated as an accused on the basis of alleged disclosure statement, the admissibility and veracity of which would be debatable.

Opposing the petition, learned State counsel submitted that since the accused has been nominated on the basis of disclosure statement, complicity of the petitioner is clearly evident. 6.

This Court has considered rival submissions addressed before this Court.

Admittedly, the petitioner was never found at the spot and has been nominated on the basis of disclosure statement of co-accused the admissibility and evidentiary value of which would be debatable. The petition, as such, is accepted and in the event of arrest, the petitioner be released on bail subject to his furnishing personal bonds and surety bonds to the satisfaction of Arresting/Investigating Officer.
