MANJARI NEHRU KAUL, J. (ORAL) Prayer in the present petition filed under Section 438 Cr.P.C. is for the grant of anticipatory bail to the petitioner in FIR No.97 dated 01.06.2023, registered under Sections 306 and 34 of the IPC at Police Station Machhrauli, District Jhajjar. Vide order dated 21.09.

2023, the petitioner had been granted interim anticipatory bail with direction to join investigation and the relevant part of the said order reads as under:- "Learned counsel for the petitioner, while drawing the attention of this Court to the allegations levelled in the FIR, which has been reproduced in the body of the petition, inter alia, contends that perusal of the same reveals that though it has been alleged therein that the petitioner along with coaccused, snatched `85,500/- from the deceased, however, snatching of money would not invite the mischief of an offence under Section 306 of the IPC, more so, when it was the case of the complainant himself that the snatched money had been taken by HC Rajpal and it was HC Rajpal who had not handed the entire sum of money to the deceased."

CRM-M-47658-2023 -2compliance of order dated 21.09.2023, the petitioner has joined investigation and cooperated with the investigating agency. Learned State counsel, on instructions from ASI Amit, does not dispute the factum of the petitioner having joined investigation and cooperated with the investigating agency. She on further instructions submits that the petitioner is not required for further investigation much less for his custodial interrogation.

In view of the above, the petition is allowed and interim order dated 21.09.2023, is made absolute subject to the conditions laid down in Section 438(2) Cr.P.C.
