Learned counsel for respondent No.1 has pointed out that the dispute in the present case is between father (appellant herein) and son (respondent No.1 herein) and that the father (plaintiff-appellant herein) had filed a suit for declaration and permanent and mandatory injunction for deleting the name of his son (defendant-respondent No.1) from the FDRs. The Trial Court had decreed the suit vide judgment and decree dated 14.01.2014. However, the First Appellate Court had reversed the same vide judgment and decree dated 27.02.2015. Aggrieved by the same, the present regular second appeal has been preferred by the plaintiff-appellant. Learned counsel has further pointed out that in the interregnum, the plaintiffappellant has since expired and the entire amount had been inherited by his son (defendant-respondent No.1).

None has put in appearance on behalf of the appellant today. 3.

In view thereof, this Court is left with no other option but to dismiss the present regular second appeal for non-prosecution. 4.
