JUSTICE SANDEEP MOUDGIL Present: None for the petitioner Mr. Chetan Sharma, DAG, Haryana --- SANDEEP MOUDGIL, J (ORAL) The instant petition under Section 438 Cr.P.C., has been filed for grant of anticipatory bail to the petitioner in FIR No.383 dated 3.9.2023, under Sections 21 (b)/61/85 of the NDPS Act, 1985, registered at Police Station Ellenabad, District Sirsa.

The petition is pending before this Court since its filing on 18.9.2023 and on various occasions the matter was being deferred for hearing before the Coordinate Bench as is evident from the orders on one or the other account and finally, this Court granted interim bail to the petitioner on 18.1.2024, subject to joining the investigation and on furnishing of personal surety/security bonds to the satisfaction of Arresting/Investigating Officer.

Thereafter, the case came out for hearing on 19.4.2024 wherein one more opportunity was got by learned counsel for the petitioner enabling him to joining the investigation but failed. Ashwani Kumar 2024.05.30 11:57 I attest to the accuracy and integrity of this document

Today none has come present on behalf of the petitioner to assist the Court and at the same time learned State counsel informs that he has not joined the investigation even till date, who is also involved in five other cases and a habitual offender.

This Court is convinced to the extent that the petitioner is not interested in availing the opportunity to join the investigation, granted by this Court.

Hence, the petition do not deserves to be pending, and his hereby dismissed.
