(ORAL ) The present petition has been filed under Section 438 of the Code of Criminal Procedure (for short 'the Cr.P.C.)' praying for grant of anticipatory bail in FIR No.249 dated 11.9.2019, under Sections 406 and 420 IPC, registered at Police Station Dera Bssi, District S.A.S. Nagar (Mohali).

On 3.10.2019, this Court had issued notice to the state and interim protection was granted to the petitioner for joining investigation.

CRM-M-42522-2019 (O&M) Learned counsel for the petitioner submits that the matter pertains to Sections 406 and 420 IPC with regard to the breach of agreement of sale executed between the parties. He further submits that the compromise has already been effected between the parties in pursuance whereof even the sale deed has also been registered. Learned State counsel, on instructions from HC Baldev Singh, states that although the petitioner has not come present but the factum of compromise is not disputed and custodial interrogation of the petitioner is not required in the present case. I have heard the learned counsel for the parties and perused the record .

Considering the totality of the circumstances, the present petition is allowed. Interim order dated October 3, 2019, is hereby made absolute.
