Petitioner Harmeek Singh has filed instant petition under Section 483 of ,$7 8$9 +-$9 , + ,. ": for grant of regular bail in FIR No.102 dated 21.06.2024 under Sections 376 and 406 of IPC registered at Police Station Women Cell, District Mohali (Annexure P1). 2.
As per facts of the case, prosecutrix 'S' filed written complaint against Harmeek Singh @ Harmeet Singh for sexual exploitation on the pretext of marriage and for forcible abortion, causing bodily harm and lateron refusing to marry her. Prosecutrix alleged that in October, 2022 she was residing in a rented house at Guru Nanak Enclave, Dhakoli, Zirakpur, District SAS Nagar, Mohali and was studying law. She met Harmeek Singh @ Harmeet Singh and their friendship grew to the point of marriage. He started having physical relations with her forcibly and even shifted in her
room. He took money from her several times which is to the tune of Rs.7.50 lakhs and also took her scooter No.PB-70-F-9662. He had also stolen her mobile phone and did not return it back. He used her ATM card and withdrew money from her account causing huge financial loss. Whenever she talked to him regarding marriage, he put off the matter several times. She came to know that he was having relation with other girls. She confronted Harmeek Singh @ Harmeet Singh for ruining her life. He started fighting with her and even gave her beating. Thereafter, he blocked her from his contact list. She tried to locate him but could not locate his whereabouts. She shifted to Jammu to stay with her parents. Even there he used to send his friends for threatening her. Finally, the matter was reported to the police. 3.
Learned counsel for the petitioner argued that he is falsely implicated in this case. Present FIR has been lodged while he was in Dubai. He was declared proclaimed offender and on his arrival in India he was arrested on 28.05.2025. Facts narrated in the FIR shows that they were in consensual relationship with each other. Without considering the facts and circumstances of the case, regular bail application filed by petitioner was wrongly declined by learned Additional Sessions Judge, Fast Track Special Court, SAS Nagar vide order dated 22.07.2025 (Annexure P-2). Petitioner is ready to abide by the terms of bail order. Therefore, his regular bail petition may be allowed.

Bail petition is opposed by learned counsel representing State. Detailed status report has been filed confirming the allegations levelled by the prosecutrix. Present petitioner is specifically named and specific role is
: attributed to him. He developed physical relation with the victim on the false promise of marriage and also used her money and activa scooter. Victim alleged that on getting pregnant, she was taken for abortion against her wishes. He was declared proclaimed offender vide order dated 21.12.2024. Finally, he was arrested on 28.05.2025 and now the trial is pending against him. Learned counsel representing State pointed out that examination-inchief of the victim has been recorded and her cross-examination is yet to be completed. Therefore, petitioner is not entitled to be released on bail. 5.
I have considered the aforesaid factual position. Trial in this case is at initial stage. After framing of charges, examination-in-chief of the victim is recorded and cross-examination is yet to be completed. At this stage, in case petitioner is granted regular bail he can influence the prosecutrix/victim. Considering the gravity of offence and the initial stage of trial, I do not find a fit case for grant of regular bail to the petitioner and the same is accordingly declined.
