Criminal Complaint No. NACT/62/2018 titled "M/s Luxmi Associates Pvt. Ltd. v/s APS Impex through its Proprietor Amrinder Pal Singh" decided on 29.02.2024 1.

Seeking setting aside of impugned judgment dated 29.02.2024 and order of sentence dated 04.03.2024 passed by JMIC, Panchkula affirmed vide judgment dated 05.08.2024 passed by Additional Sessions Judge, Panchkula in the complaint captioned above, the petitioner has come up before this Court. 2.

Counsel for the respondent submits that there is another petition against the conviction i.e. CRR No.1763 of 2024 in which the parties have compromised the matter by entering into a settlement.

Counsel for the petitioner on instructions submits that they undertake to comply with the terms and conditions of compromise entered in Mediation proceedings and consequences of the said compromise also relates to this petition also. 4.

Counsel for the respondent submit that four years time has been given to the convict to clear his outstanding amount. In this background, the Co-ordinate Bench of this Court had admitted the petition and had given liberty for listing of the petition after the terms of compromise as mentioned in the Mediation proceedings are complied with by filing appropriate application.

Counsel for the petitioner submits that 20% of the amount has already been deposited with the Registry of this Court in this case. The factum of compromise is not disputed.

Given above, there is no reason to keep this petition pending. Petition is allowed. Judgment of conviction and order of sentence is set aside on the basis of compromise. Registry to release payment deposited by the petitioner along with whatever interest has accrued in favour of the complainant on an application mentioning account details. Bail bonds and surety bonds are discharged. All pending applications, if any, stand disposed of. It is clarified that parties shall remain bond by their undertaking before the Mediation and Conciliation Centre.
