(Oral) The present petition has been filed under Section 528 of Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023 seeking direction to official respondent to stop repeated enquiries in case FIR No.101 dated 03.05.2025 (Annexure P-2) under Sections 420,465, 467, 468, 471, 506 IPC, 1860 registered at Police Station Gurdaspur District Gurdaspur. 2.

Learned counsel for the petitioner contends that second enquiry is being conducted on the basis of the same FIR by way of an application made to the DIG border Range, Amritsar which has been marked to S.P. (D), Majitha as earlier investigation of said FIR has already been concluded which is in favour of petitioner vide investigation report dated 12.04.2025 and the second enquiry based on same set of allegations is not permissible as per law. 3.

Mr. Kamalpreet Bawa, DAG, Punjab, accepts notice on behalf of the respondent-State and submits that there is no such inquiry marked, however only investigation is taking place in the aforesaid FIR, in accordance with law. 5.

Keeping in view the facts and circumstances of the case and the submission so made by learned counsel for the State and further without commenting upon the merits of the case, the present petition is disposed of with observation that in case the petitioner is required for the purpose of investigation, it is expected that the same shall be conducted in an fair and impartial manner. 6.
