This petition has been filed under Section 24 read with Section 151 C.P.C. for transferring the petition titled as "Rajeev Soni Vs. Jyoti Soni" filed by the respondent under Section 13(i)(1-a)1(b) of the Hindu Marriage Act, 1955 (hereinafter referred to as `the Act') for dissolution of marriage by a decree of divorce, from the Court of learned District Judge, Family Court, Faridabad to District Judge, Family Court at Bhiwani. Notice of this transfer petition was issued to the respondent. Mr. R.S. Hooda, learned Advocate has appeared on behalf of the respondent and contested this petition.
I have heard learned counsel for the parties and have gone through the record.
From the record, I find that the distance between Faridabad and Bhiwani, as argued, is about 155 kms. There is no male member to HARPAL SINGH PARMAR 2015.08.03 16:54 I attest to the accuracy and authenticity of this document Chandigarh
T.A. No.486 of 2013 [2 accompany the petitioner to attend proceedings at Faridabad. There is one minor daughter with the petitioner and it is difficult for her to visit Faridabad along with her minor daughter nor she can leave her at house alone.
Therefore, keeping in view the inconvenience to the petitioner and in view of the fact that she is having no sufficient income for spending on travelling etc. and the convenience of wife is to be seen in the matrimonial case for transfer of the case, I find merit in this petition and the same is accepted. The above petition filed under Section 13(i)(1-a)1(b) of the Act by Rajeev Soni against Jyoti Soni, pending in the Court of learned District Judge, Family Court, Faridabad is transferred to the Court at Bhiwani.
The parties are directed to appear before the learned District Judge, Bhiwani on 20.8.2015, who will be at liberty to keep this case with him or may entrust the same to any Court of competent jurisdiction at Bhiwani, who will proceed as per law for disposal of the same. The learned District Judge, Family Court, Faridabad is directed to send the file of the above case to the learned District Judge, Bhiwani well before the date fixed.
The petition stands disposed of accordingly.
