The petitioner incarcerated in the FIR captioned above has come up before this Court under Section 439 CrPC seeking bail.

Vide order dated 03.10.2023, this Court had granted interim bail to the petitioner, which is continuing till date.

Petitioner's counsel submits that they have voluntarily complied with the previous order dated 03.10.2023 and handed over affidavit of the petitioner to the state counsel. He further submits that affidavit of petitioner's spouse could not be prepared as their relations are not cordial.

On instructions, counsel for the State has not disputed the contention made by counsel for the petitioner.

Given above, order dated 03.10.2023 qua declaration of assets of petitioner's spouse is recalled. In the entirety of facts and circumstances and petitioner's pre-trial custody of approximately 05 months, there is no need for further custody, as such interim order dated 03.10.2023 is made absolute.
