Through the instant second petition under Section 439 Cr.P.C., prayer is made for grant of regular bail to the petitioner in case FIR No. 110 dated 17.10.2022, under Sections 22, 29/61/85 of NDPS Act, registered at Police Station Sandaur, District Malerkotla.

Considering the recovery, and the fact that the petitioner is involved in three more cases, out of which two are of NDPS Act, and one is under Section 302 IPC, this Court is not inclined to grant the asked for relief of regular bail, at this stage.

Learned State counsel placed on record custody certificate of the petitioner, and the same is taken on record. A perusal of the custody certificate reveals that the petitioner has suffered incarceration of 2 years, 3 months, and 21 days, as on date, and out of 14 prosecution witnesses, 2 witnesses have been examined, and 5 witnesses have been given up, therefore, only 7 prosecution witnesses remained to be examined, this Court deemed it appropriate to pass mandamus upon the trial court to make DALBIR SINGH TIWANA 2025.02.15 09:54 I attest the accuracy and authenticity of this order/judgment Chandigarh

CRM-M-45682-2024 all efforts to examine the remaining prosecution witnesses within 6 months from today. The mandamus is also passed upon the SSP concerned to ensure the presence of all the official witnesses, as and when called, by the trial court concerned. Any lapse on the part of the SSP concerned shall be construed seriously by this Court.

Disposed of accordingly.
