RAJ MOHAN SINGH, J. (ORAL) The petitioner has preferred this writ petition for setting aside the order dated 08.09.2023 passed by the Superintendent, Central Jail, Bathinda, declining the prayer of the petitioner for releasing him on parole for 08 weeks. Though the order has not been passed by the District Magistrate but the fact remains that while on parole, the petitioner was involved in new case bearing FIR No.16 dated 28.01.2023 under Sections 21B, 61, 85 of the NDPS Act, Police Station Kotwali, Bathinda.

Due to registration of the case, he did not surrender in the jail premises on 04.03.2023. Period of one year has not expired from the date of registration of the aforesaid FIR. NEHA 2023.10.17 17:29 I attest to the accuracy and integrity of this order/judgment

2023:PHHC:134880-DB CRWP-9402-2023 -2The petitioner has been involved in a new case for which he was arrested on 30.01.2023, therefore, the conduct of the petitioner is not being considered as good conduct for releasing him on parole.

The petition stands dismissed.
