(ORAL) Prayer in the writ petition is for issuance of a writ in the nature of mandamus directing the respondents to consider case of petitioners for granting ante-dated promotion benefits w.e.f. 01.01.1996 arising thereto under 3% reservation earmarked for physically handicapped employees as per Haryana Government notification dated 03.02.2017 (Annexure P-3) and letter dated 17/19.04.2017 (Annexure P-4) and as per provisions of Persons with Disability Act, 1995.

Learned counsel contends that the petitioners, at this stage, would be satisfied if a direction is issued to respondent No.2 to consider and decide the representations dated 27.03.2019 (Annexure P-5) and 28.03.2019 (Annexure P-6) filed by them, within some specified time. In view of the statement made by the counsel for the petitioners and without going into the merit of the case or commenting thereon, the present writ petition is disposed of with directions to respondents No.2 to decide the representations dated 27.03.2019 (Annexure P-5) and 28.03.2019 (Annexure P-6) within a period of two months from the date of receipt of certified copy of this order.

CWP No.28850 of 2019 (O&M) -2In case the claim of the petitioners is to be accepted, the consequential benefits, if any, be released to them, in accordance with law and if the claim of the petitioners is not to be accepted, then a well reasoned and speaking order be passed and conveyed to the petitioners forthwith. It is made clear that in case the representations are not decided within two months, there shall be costs of `25,000/- to be paid to the petitioners.
