Oriental Insurance Company Limited v. Suresho Devi And Others
IN THE HIGH COURT OF PUNJAB AND HARYANA
AT CHANDIGARH ***** FAO No. 4595 of 2022 (O & M) Date of decision : 28.10.2022 Oriental Insurance Company Limited ......Appellant Vs.
Suresho Devi and others ......Respondents CORAM: HON'BLE MR. JUSTICE TRIBHUVAN DAHIYA
Present:
Mr. Aseem Aggarwal, Advocate, for the appellant --- TRIBHUVAN DAHIYA , J. (Oral) 1.
This is an appeal filed by the Insurance company challenging the award passed by the Motor Accident Claims Tribunal, Panipat (in short 'the Tribunal') dated 1.9.2022, whereby compensation has been awarded to the respondents/claimants on account of death of Pyare Lal on 12.11.2020,, by assessing his income as Rs.15,000/-per month being skilled person. 2.
The only argument raised by learned counsel for the appellant is that wages notified by the Government in 2020 for 'skilled labour' were less than Rs.15,000/-per month. He, however, could not dispute and no evidence to that effect was brought on record of the Tribunal. Therefore, there is no ground to impugne the findings of the Tribunal with regard to assessment of deceased's income on that basis.
3.
Dismissed.
4.
Pending applications, if any, are disposed of as having been rendered infructuous.
