The petitioner through instant petition under Article 226/227 of the Constitution of India is seeking setting aside of order dated 12.11.2021 (Annexure P-1) whereby he was ordered to retire on the expiry of notice period.

The petitioner approached this Court by way of instant petition. Notice of motion was issued and there is no order on record disclosing that operation of impugned order was stayed, nevertheless, the respondent permitted the petitioner to remain in service. Period of almost four years from the date of impugned order has passed away. By his act and conduct, respondent has withdrawn the impugned order. Thus, this Court finds it appropriate to direct the respondent to allow the petitioner to remain in service.
