The petitioner through instant petition under Article 226 of the Constitution of India is seeking setting aside of: i) Office order dated 12.01.2024 (Annexure P-20) whereby major penalty of compulsory retirement and recovery of Rs. 11,66,667/- was imposed; and ii) Order dated 11.06.2025 (Annexure P-23) whereby his appeal was dismissed.

Learned counsel for the petitioner submits that instant may be disposed of in terms of order dated 02.09.2025 passed in CWP No. 19265 of 2025, titled as "Balwinder Kaur vs. Chandigarh Industrial and Tourism Development Corporation Limited and another". On being confronted with aforesaid order, counsel for the respondents expressed her inability to distinguish the instant case from aforesaid order, however, submits that petitioner was actual accused and he was the mastermind behind the alleged offence. 4.

This court has not expressed opinion while passing order in Balwinder Kaur (Supra). The instant petition deserves to be disposed of in terms of Balwinder Kaur (Supra).
